JoAnn29 and the others have answered exactly as I would. Their advice is solid. You must find an elder care attorney...NOT just any attorney. If one parent needs to go eventually to a nursing home and the other does not or does not right away, you must make sure that the assets of the other parent are protected. If you fail to do this, the results can be very stark, indeed. So, this is not something that you can put off.

First issue is finding a lawyer that specializes in elder law. They are a rarity in many areas. Even more difficult is finding an attorney that actually has in-depth expertise in Medicaid. I have yet to find one. Every attorney will claim expertise but when you get down to nuts and bolts, you end up paying them for education.

This is a question for an elder lawyer. Medicaid gets complicated when their are spouses who both need care.
