My mother is in a nursing home and Area of Aging is her guardian. They have kept me from seeing my mother since March. I went to the nursing home to take my mother for the day, they informed me that I couldn't take her. I was very upset about the situation and I was told to leave or I would be arrested. Prior to my mother's stroke she resided with me. What can I do to see her and is this legal to do?

Had a message from OP. She explained that her mother had a stroke and was in rehab. Has fully recovered and is of sound mind but seems they refuse to release her. The facility chose to get the State involved and Mom was assigned a guardian.

There is a reason why Mom was removed from her home. APS must have felt she was not safe for whatever reason. Allowing u not to visit may have been their way of allowing Mom to adjust.

I also think you need to talk to the person who was assigned to Mom. Sorry, but you no longer make the decisions for Mom, the guardian assigned does. You should understand what you can and can't do. If you stay within those boundries, you should be able to visit Mom. But remember, you are not able to get any info on her care. This u will need to ask the guardian about. You cannot complain to the staff, you will just be a visitor. There is no way you or anyone would be able to take Mom out. This would have to be OKd by the guardian.

To have any rights, you have to abide by them. The Government is now in control and for a reason.

Area Agency on Aging is awarded guardianship by a judge. This really has me wondering why your mom was removed from your home to keep her safe.

I would talk with the guardian (AAA) to ask what you need to do to be able to see mom.

Are you able to visit her inside the Nursing Home? they likely do not permit you to take her off the premises because they feel it would be unsafe for your Mother. But you should be able to visit her. as far as being arrested, if you were making a scene at the Nursing Home they have every right to remove you from there as you were being disruptive and possibly upsetting the residents. Why is Are of Aging her guardian? Did APS get involved? Were you abusive to Mom? Financially, emotionally or otherwise? More info would be helpful.

Obviously there is more to this situation than is being shared, but my best advise is to talk to a lawyer.
