My Mom lived with me for the last 4 months.

At first it was just her account, then my brother had his name to her acct. So he has stop her from signing and withdrawing funds out of the acct. So when her social security check goes in the accounts she can't get anything out. I have contacted social security, we are doing a debit card for her check to be put on.

Is your mom competent? Why are her social security checks going to your brother?

Have your mom call the Social Security Administration and have this stopped.

The next phone call I'd make is to an elder law attorney.

Does the check go to your Mom's account (and he is POA) or to an account in her name that happens to be at his bank. Open an account for your Mom near your home. Go online and have her social security check directed to the new account (In your Mom's name). Then she can contribute to her care or pay her bills. It would be better if you provided more info.

good idea tisha, now take mom to the bank and get bro off the account. If there is money missing, get a senior services lawyer to help you.

POAs who don't do their job and act in the best interest of the person served can be removed, and rep payees are also supposed to be accountable. I know its yoru brother and you would naturally hesitate, but if theft has been committed, involve the police anyways - otherwise you may run afoul of Medicaid look-back and "gifting." Getting eldercare attorney advice is rarely a bad idea. Some offer free or reasonably priced initial consultation. Be careful that YOU document well everything spent for her and her care once you have regained that control.
