Dad's girlfriend helped him hire a non appointed lawyer. Lawyer now billing me. I had DPOA three years before my Dad was diagnosed with Dementia. A neurologist activated my DPOA and also added diagnosis of Althizmer. My Dad met a woman online and she helped my Dad get my DPOA revoked. I proceed to apply for Guardianship, she took my Dad to OK. and got married. It took 7 months to have court appointed me as guardian. I paid my lawyer, court appointed lawyer and now Dad's lawyer billing me because Dad & wife refused to pay balance due. Dad's lawyer states I need to pay him since Dad is my ward. What should I do?

Read the court decision, it usually says who pays the court fees and legal fees. Usually you would pay this from his funds, since you are the Guardian. You take your court order to the bank to prove you are in charge.

I think the lawyer means that you need to pay him out of your father's assets, not your own. That would be your job as your father's guardian, assuming your father is liable. I wouldn't assume that, however. I would say it's solely his wife's responsibility. Even if both of them signed on with the lawyer, she did that knowing that he was incompetent. She shouldn't be allowed to bring a lawsuit in the name of an incompetent person when she is not the guardian.

I think that should be your first answer to the lawyer: You did not, as your father's guardian, retain him, and you will not, as your father's guardian, pay his bill.
