My mother passed away. She passed away without a will or life insurance. My cousin and I paid for expenses, none of my siblings offered anything or helped on the payment plan of the costs. After her passing, right away I knew something was wrong with the story of how she passed- everyone did- so I hired a lawyer and come to find out there was wrong doing. Everyone aware of lawyer and lawsuit know that it's time for settlement. Siblings want it all, and say I should not get paid back for funeral expenses from my savings and also had to pay on payment plan. Is it wrong of me to get paid back?

No, is absolutely RIGHT for you to be paid back for the funeral.

Seriously--and of course they'll want their cut of the lawsuit, right? Well, give it to them, minus their "share" of funeral expenses. Let them howl.

Before there is any distribution of proceeds all of your expenses should be reimbursed in full.

Seems like a no-brainer to me. Of course you and your cousins should be reimbursed any funeral costs.

But, out of curiosity- what reasons do your siblings give for you to not receive reimbursement? Did you have any monies owed to your mother - say, like paying back a loan mom made to you?

Cause barring any reason such as mentioned above - this just is one nutty “request” being made by your siblings.

You have a lawyer have him split up the proceeds making sure those who paid for the funeral get reimbursed and he does too.

With the money that will be rewarded that still has not been rewarded because it is still being written I was going to give to my sibling but they called and said all money should be split and I should not want to be paid back for paying for moms funeral

Absolutely you should be reimbursed for all of the funeral expenses you incurred. Not just the funeral home but such things as newspaper notices to close the estate or anything else.

Wormy - who will receive the financial award? If it is your mothers estate then that along with any assets she had will require going through legal probate- especially since your mother did not have a will.

A probate judge will order that any outstanding debts be paid off the top - prior to any division of assets to heirs.

You need to get your receipts in order or whatever documentation you may have concerning what you paid for funeral expenses. Have your attorney help submitt them to the probate court for your reimbursement. Screw your siblings. Sheez!

Thank you for your answers this has been very hurtful and I was confused about was I being fair to get funeral expenses paid back the way they spoke to me it was so disrespectful I have receipts now I just have to wait for the next steps
